consisting of self contained
apartments, reserved car
parking, other features etc.

2. |
Application for allotment of
apartment should be made on
the prescribed application
from duly signed by the
applicant along with the
earnest money. Hyperion
Builders & Momen Real
Estates consortium has the
right to accept or reject
any application without
assigning any reason there
to. |

3. |
On acceptance of an
application, Hyperion
Builders & Momen Real
Estates consortium will
issue an allotment letter
with specific terms &
conditions. The applicant /
allottee shall then start
making payments as per the
schedule of payment.
Allotment of apartments is
made on first come first
served basis. |

4. |
All payments of earnest
money, installments, and
other additional works and
other charges shall be made
by Cheque, Bank draft or pay
order in favor of Hyperion
Builders & Momen Real
Estates consortium for which
respective receipts will be
issued. |

5. |
Payments of installments.
Car park costs and all other
charges are to be made on
due dates. Hyperion Builders
& Momen Real Estates
consortium may issue
reminders to the allottee
but, notwithstanding the
issue of reminders, the
allottee must adhere to the
schedule of payments to
ensure timely completion of
construction. |

6. |
Delay in payments beyond the
due date will make to
allottee liable to pay a
delay charge of 3% per month
of the account of payment
delayed. If the payments is
delayed beyond three month.
Hyperion Builders & Momen
Real Estates consortium
shall have the right to
cancel the allotment. In
such an event the amount
paid by the allottee will be
refunded after deducting Tk.
50,000/ ( Fifty thousand
only) |

7. |
Hyperion Builders & Momen
Real Estates consortium and
the allottee will be
required to execute an
agreement for safeguarding
the interest of the allottee
as well as. |

8. |
Connection fees / Charges,
society deposits & other
incidental expenses relating
to gas, water, sewerage and
electric connections are not
included in this price of
apartments, these payments
will be made by Hyperion
Builders & Momen Real
Estates consortium directly
to the authorities
concerned, on the allottees
accounts. The allottee will
be billed proportionately on
actual costs basis. |

9. |
Limited changes in the
specifications/design/layout
of the apartments and other
facilities may be made by
Hyperion Builders & Momen
Real Estates consortium in
larger overall interest or
due to unavoidable reasons.
Limited changes in layout
facilities may also be done
as per allottees choice on
his (allottee) account. For
this prior notice of sixty
days is a must. |

10. |
The possession of each
apartment shall be duly
handed over to the allottee
on completion and on full
payment of installments and
other charges and dues till
then the possession will
rest with Hyperion Builders
& Momen Real Estates
consortium. |

11. |
The Allottee will pay stamp
duties, registration fee,
documentation charges and
any other taxes &
miscellaneous expenses
likely to be incurred in
connection with the
allotment, registration,
transfer etc. only the
actual sums will be charged. |

12. |
After taking over of
apartment of the project,
the allottee(s) must consult
Hyperion Builders & Momen
Real Estates consortium
prior to undertaking any
structural or layout changes
within the apartment
complex. Failure to do so
will be at the sole risk of
the allottee(s) |

13. |
The Schedule of
Implementation has been
methodically prepared to
ensure both high quality and
smooth progress of work.
Construction is scheduled to
be completed within 18 month
from the date of
commencement of work. |

14. |
The completion period of the
construction of the project
can be affected by
unavoidable circumstances
beyond the control of the
company, like force majeure,
natural calamities,
political disturbance,
strikes and changes in the
fiscal policy of the state
etc. |

15. |
For the management of common
facilities like the supply
of electricity, water and
sewerage and the maintenance
of the building etc. Owner's
Association will be formed.
All allottees, after full
payment of instalments and
dues must become members of
this Association for the
common interest. Each
allottee (for each allotment
of apartment) must initially
deposit TK.25,000 (Taka
twenty five thousand) only
in the Reserve Fund for the
management expenses of the
complex.
